Touchland Rewards Program Terms and Conditions of Participation

Thank you for your interest in participating in the Touchland Rewards Program (“Rewards Program”). This Rewards Program is offered at the sole discretion of Touchland LLC, doing business as Touchland ("Touchland", “we”, “us”, or “our”) and is subject to the term and conditions of this Rewards Program Terms of Use (the “Rewards Terms”) and the Touchland Terms of Service (the “Terms of Service”), each as may be modified from time to time. By participating in the Rewards Program, you agree to be bound by these Rewards Terms and the Terms of Service. If you do not agree to be bound by these Rewards Terms or the Terms of Service, you may not participate in the Rewards Program.

PROGRAM ELIGIBILITY & MEMBERSHIP

1. The Rewards Program allows members to earn points (“Touch Points”) in connection with the purchase of Qualifying Products (defined below) and the performance of Qualifying Activities (defined below), as defined below, that are redeemable towards the purchase of certain products. Earning Touch Points, redeeming rewards and tracking your activity is done through the My Rewards dashboard (the "Dashboard") on the Touchland website located at www.touchland.com (the “Website”). You must be logged into your Rewards Program Account (“Account”) to navigate these functions on the Dashboard.

2. The Rewards Program is available to all individuals who are United States residents, 18 years or older, and have an active Account.

3. You can create an account on our Website by signing up in the Dashboard.

4. There is no purchase, payment, or credit card required to participate in the Rewards Program.

5. You may only participate in the Rewards Program through one Touchland account. We apply a limit of one membership per person and registered email address. Any Touch Points or benefits earned through the use of more than one Account will not be redeemable, transferred to or merged with another Account.

6. You are responsible for all activity that is conducted through your Account. This means you are responsible for making every effort to keep your email address and password secure and private. We advise using a unique password that has not been used on any other account. If your password or account is compromised, we advise you to change it quickly or reach out to customer service for further assistance.

EARNING & REDEEMING TOUCH POINTS

1. The Rewards Program allows members to earn Touch Points in connection with the purchase of Qualifying Products (defined below) and the performance of Qualifying Activities (defined below), as defined below, that are redeemable towards the purchase of certain products. 

QUALIFYING PURCHASES

1. A Qualifying Purchase is a purchase of a regular or sale priced item or up to 9 bundled items on the Website while logged into your Account. PURCHASES OF THE FOLLOWING ITEMS ARE NOT QUALIFYING PURCHASES: PURCHASE OF eGIFT CARDS, SALES TAX, STATE FEES, SHIPPING CHARGES AND SHIPPING INSURANCES, DELIVERY CHARGES OR OTHER EXCLUDED CHARGES SPECIFIED BY TOUCHLAND FROM TIME TO TIME. 

2. A Qualifying Purchase will earn 1 Touch Point per $1 spent, but may earn more Touch Points per $1 spent if the Qualifying Purchase is made in connection with a bonus point event.  If the Touch Points from a Qualifying Purchase have posted and the item purchased as part of the Qualifying Purchase is returned to us, then the Touch Points earned for the returned item will be deducted. 

QUALIFYING ACTIVITIES

1. A Qualifying Activity is an activity you can perform to earn a specified number of Touch Points. The Qualifying Activities that members can perform and the corresponding Touch Points earned are listed in the ‘Ways to earn’ section on the Dashboard. The Qualifying Activities that members can perform include, but are not limited to, creating an account, shopping with us, on your birthday (where you provide your birthdate with us), writing a review, uploading a photo to a review, following us on TikTik, or Instagram, and referring a friend to purchase. To earn Touch Points in connection with most of the Qualifying Activities you must be logged into your Account. You can refer your friends by providing them with a link located in the ‘Refer your friends’ section of the Dashboard, providing them with a 10% off coupon. When they make a purchase, you earn Touch Points. A Qualifying Activity will earn the amount of Touch Points specified for the particular activity in the Dashboard.

REDEEMING TOUCH POINTS

1. You must be logged into your Account to earn and redeem Touch Points. 

2. Touch Points redeemed can’t be used in combination with other automatic discounts offered on our website. Our system only allows 1 offer per purchase.

3. Once you have sufficient Touch Points you may redeem the Touch Points as detailed in the ‘Ways to redeem’ section of the Dashboard. When you have earned 50 points, you can redeem a $5 off discount, when you have 100 points, you can redeem a $10 off discount.

4. Items purchased using Touch Points are subject to the Touchland return policy.

 

2. Touch Points are nontransferable. Touch Points cannot be combined with another member's Touch Points. Touch Points have no cash value and cannot be redeemed for cash at any time except where required by law. Touch Points have no purpose or use other than to be redeemed as detailed in the ‘Ways to redeem’ section of the Dashboard. Touch Points will only be redeemable by the member to whom they are issued. Touch Points are not transferable in the event of death or divorce and do not constitute property of the member.

3. Once a Touch Point is redeemed it cannot be re-used or re-issued. Touchland reserves the right to limit the quantities of Touch Points redeemed by a single member in a given time period. Touch Points are not valid unless earned in strict compliance with the requirements established and intended by Touchland, and members shall not attempt to earn Touch Points by any means (including without limitation, by using any script, bot, data mine or other automated means) that only simulates applicable requirements, or by any fraudulent activity such as making false referrals.

4. The sale or barter of any Touch Points offered through the Rewards Program, other than by Touchland, is expressly prohibited.

5. Touchland reserves the right to make promotional offers selectively available to members, based on purchase activity, geographic location, program participation, or other factors.

TOUCH POINT EXPIRATION

1. Unredeemed Touch Points will expire 12 months after issuance. 

ACCOUNT INFORMATION

1. Any personal information you provide in connection with the Rewards Program will be handled as detailed in our Privacy Policy which is hereby incorporated by reference. 

COMMUNICATIONS

1. By participating in the Rewards Program, you will periodically receive emails from us related to your membership in the Rewards Program, such as emails informing you that you have enough Touch Points to redeem a rewards coupon and that a referred friend has made a purchase. If you do not want to receive these emails you have the option to unsubscribe at any time.

CHANGES, TERMINATION, REMOVAL FROM REWARDS PROGRAM

1. You may cancel your membership to the Rewards Program at any time by emailing customerservice@touchland.com

2. If you cancel your membership any Touch Points which remain in your Account will be forfeited.

3. Touchland may, at its sole discretion, terminate, alter, limit, suspend or modify the Rewards Program, and/or these Rewards Program Terms at any time, in case of changes to applicable laws, changes in services provided by Touchland or introducing new services. Any material change will take effect after 14 days from the date on which you have been informed of such change either in the Dashboard, on www.touchland.com, or via mail or a combination thereof. If you do not accept the changes you have the right to cancel your membership.

4. Touchland reserves the right to make minor changes to the Rewards Program and these Rewards Program Terms without providing you with prior notification, provided that these changes do not materially affect the membership in a negative way. Please make sure to stay updated on these Rewards Program Terms.

5. Any violation of the Rewards Program rules, proven or probable fraud, non-compliance with the terms, inactivity on the account, provision of incorrect data, or any act detrimental to Touchland's interests (determined at Touchland’s sole discretion), may lead to the termination of, and/or impact your ability to participate in the Rewards Program. If your participation in the Rewards Program is canceled, all Touch Points shown in the Dashboard will automatically expire.

LIMITATION OF LIABILITY

1. Touchland will not be liable for any system failure or malfunction of the Rewards Program or any consequences thereof. Touchland accepts no liability for any loss or damages arising from suspension, variation, or termination or in any other way relating to the Rewards Program, except for any liability which cannot be excluded by law.

APPLICABLE LAW AND JURISDICTION; DISPUTE

1. These Terms and Conditions shall be governed by the laws of the jurisdiction detailed in the Terms of Service.

2. In the case of a dispute regarding the administration of the Rewards Program, or the Touch Points, or other benefits available to a member, Touchland's decision, determined at its sole discretion, will be final. A member's exclusive remedy in the event of any questions related to the Touch Points or other benefit earned by or available to a member shall be the issuance of the Touch Points or other benefits, if available, or such other comparable benefit as determined by Touchland, in its sole discretion, which shall have no additional liability whatsoever.
